Terms of Service
Last updated: [Date]
1. Acceptance of Terms
By creating an account, posting a job, or accepting a job through 1Call2Haul (the "Platform," "we," "us"), you agree to these Terms of Service. If you don't agree, don't use the Platform. The Platform connects individuals who need items hauled ("Customers") with independent drivers who provide hauling services ("Drivers"). 1Call2Haul is a technology platform — it does not itself provide hauling, moving, or transportation services.
2. Scope of Service
- Drivers provide transportation of items from the pickup location to the drop-off location only.
- Loading and unloading inside a home, business, or property is not included as part of the core service and is at the Driver's and Customer's mutual discretion.
- The Platform's role is limited to facilitating the connection between Customers and Drivers, processing payment, and providing the app used to arrange trips.
3. Optional Assistance and Tips
- Any assistance with carrying items, navigating stairs, or placement inside a property is a separate, optional arrangement made directly between the Customer and the Driver. It is not required, arranged, or guaranteed by the Platform.
- Any additional payment, gratuity, or tip for that assistance is handled directly between the Customer and Driver, outside of the Platform.
4. Customer Responsibilities and Liability
- Customers are solely responsible for packing, wrapping, and preparing their items prior to pickup.
- Drivers are responsible for properly securing and tying down items within their vehicle during transport, since the vehicle and its safe operation on the road are within the Driver's control.
- 1Call2Haul is not liable for damage resulting from a Customer's improper packing or preparation of an item prior to pickup.
- 1Call2Haul is not liable for damage resulting from a Driver's failure to properly secure an item during transport; responsibility for such incidents rests with the Driver as an independent contractor.
- Customers should disclose the nature, size, weight, and any special handling needs of items honestly when posting a job.
5. Driver Terms
5.1 Independent Contractor Status. Drivers are independent contractors, not employees, agents, or partners of 1Call2Haul. Drivers are solely responsible for maintaining a valid driver's license, vehicle registration, and insurance coverage sufficient for the vehicle and cargo they transport, and for properly securing and tying down all cargo before and during transport. Drivers control their own schedule, choose which jobs to accept, and use their own vehicle and equipment.
5.2 Verification and Fees. Drivers must complete a third-party verification process, covering ID check, driver's license validity, background check, and proof of insurance, before accepting jobs. Drivers pay a one-time verification fee covering this process; the Platform does not subsidize this cost. Once approved, a Driver's verification remains valid for approximately two years, subject to random selection for recertification during that period. If selected for recertification, a Driver must complete and pay for it within the specified window, or their account will be paused until they do so. The verification fee can typically be earned back on the Driver's first completed trip (minimum job amount: $60).
5.3 Payout Structure. Drivers receive 75% of the base trip amount; the Platform retains 25%. Drivers who complete 10 consecutive trips with no customer complaints and no incident reports earn a temporary bonus rate of 80% (Platform 20%) for their next 5 trips, after which the rate returns to the base 75/25 split. This bonus can be earned again by achieving another 10-trip perfect streak.
6. Cancellations and No-Shows
- If a Customer cancels after a Driver has already accepted the job and is en route, a cancellation fee may apply.
- Drivers who repeatedly cancel accepted jobs or fail to show up may have their account paused or deactivated at 1Call2Haul's discretion.
7. Payments
- All payments are processed electronically through the Platform. Cash payments for the core hauling service through the Platform are not permitted.
- Payment is authorized when a Customer posts a job and captured once the job is marked complete.
- Driver payouts are transferred to the Driver's linked payout account after job completion.
8. Limitation of Liability
To the fullest extent permitted by law, 1Call2Haul is not liable for indirect, incidental, or consequential damages arising from use of the Platform. 1Call2Haul's total liability for any claim related to a specific trip is limited to the amount paid for that trip. The Platform is provided "as is" without warranties of any kind.
9. Account Suspension and Termination
1Call2Haul may suspend or terminate any account (Customer or Driver) for violation of these Terms, fraudulent activity, safety concerns, or failure to complete required verification/recertification. Drivers suspended for missed recertification may reactivate their account by completing the recertification process.
10. Dispute Resolution
[To be finalized with legal counsel.]
11. Changes to These Terms
1Call2Haul may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
